I absolutely agree with you g-man. I was not making a legal argument. I was positing, without underlying explanation, that a society where there are now Republican establishments and Democratic establishments is a problem for a well functioning lowercase-“l” liberal democracy. The expanding ability in our world to avoid those who think differently I view as problematic. I was not suggesting a legal solution, just commenting on how I would urge others to act. And I shed no tears for Sarah. 

The Supreme Court has overruled a precedent in the S. Dakota sales tax case of a few days ago.  Today, they overruled a precedent in a case involving unions, fees and labor law.
 
Whenever there is a nominee to the S. Ct., the Democrats and liberals ask about the nominee’s views on stare decisis – the idea that precedent is precedent and should not be overruled because of ideology. The questions are posed because the Democrats and liberals are concerned about the health of Roe v. Wade, the abortion decision.  The nominees always say, “I can’t comment on matters that might come before the Court, but Roe v. Wade is existing law, it is long established, and it is the “law of the land” and that’s all I can say.”
Well, swell.  The cases that the S. Ct. overrruled in the S. Dakota case and in today’s case, JANUS v. AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES,
COUNCIL 31, ET AL.  were also precedents.
On the other hand, Brown v. Board of Education overruled Plessy v. Ferguson, the earlier precedent which held the opposite way.

Trump the clueless blames everyone except his party for immigration issues. Republicans control the house and today there was a vote on a GOP leadership backed immigration bill.  The house voted 121-301 to defeat the GOP leadership backed bill! 

Can’t wait to watch Trump and Napa spin this and how it is EVERYONE’S fault except... 

Now, back to Trump and his vacation planning trip with Putin. 

JC, perhaps but let’s see. Remember, it only takes one republican to block the nomination and you know an all out effort will be made to hold off until November by the democrats. 

JC, surely you recall it was the republicans and McConnell who think one should wait to nominate a justice in election years until AFTER said election, correct?

But of course, but that only applies if it is the Dems who get to choose - Congress will rubber stamp whoever El Jefe nominates with no delay to avoid the minor chance that Dems would be able to block nominations after midterms

I’m not confident Democrats can count on Manchin to block. I *think* VP is capable of breaking a tie for SC nominee. He can for cabinet positions. That means at least 2, possibly 3 of McCain, Flake, Collins, Murkiwski will have to oppose. 

 

The President and his associates are under active investigation for conspiracy with a foreign adversary and obstruction of justice. He should not get to pick a SC nominee until that investigation is completed. 

 

But he will. And the nominee will probably be confirmed. Elections have consequences. And Democrats are really bad at winning elections. 

Im bummed about this dipstick getting another SC nominee but Im not sure I buy its earth shattering to the courts ideology. Besides abortion and gay rights, yes I know those are two HUGE issues, Kennedy was a reliably conservative vote.

 

On the issue of a tie, I dont think it will be an issue. Doubt McCain will be able to vote so there is an odd number of Senators. Although, the thought of him coming back more time to vote no and stick it to Trump is delicious.

I’d agree with all of this. 

(Edited to add: I actually don’t *think* there will be an about-face on gay marriage. Praying that I’m right. But I’m tremendously concerned with the repeal of abortion rights in this country.)

Please our friends' restaurant got trolled by some of these morons who believed they were the Red Hen.  Their restaurant has neither red nor hen in the title and is located in Key West, Florida.  FKG posted a map and noted the difference between Lexington KY and Key West on it to assist the MENSA member
