It appears there are no rules specifically against the heat being off, and we'll probably have to seek legal counsel to advise how best to proceed. I think it makes sense I should have recourse, but we'll see what happens.

You should make a claim against your own homeowner's coverage. They will pay you for damage to your place, subject to whatever deductible you may have, and will go after the upstairs tenant to recoup their money. If they are successful, you'll get the deductible back.

That being said...what is a "public adjuster"? We had an adjuster (if that's the right term) from both our own insurance company as well as our association's insurance company, so I'm not sure what a public adjuster would be.
