I can just imagine an IRS or State revenue agent, creating a moniker in these boards, getting Matt's name and address, and tracing your name to a wine shop or wine consignment/storage facility in CA, Vegas, or Neverland.

Hi all,
I just discovered an interesting fact - apparently it's against Federal law for individuals in different states to ship wines to each other unless they are registered dealers. I may have the details incorrect, but basically, if you don't have a license, you can't legally ship wine.

My point is that with all the crap about breaking laws, who here has broken this one?

Something about casting stones, or stoning cast or ...

I am only talking about sales tax that CA or NV would probably want. Not even addressing the possibility of capital gains taxes the Feds migh seek.

I also have no dog in the fight, but I am a fan of full disclosure.

In most cases, this would be a use tax issue. If we assume Matt has a wine business, and the wine is based in either CA or NV, then he would have no need to collect sales tax unless the wine was shipped in state. Once he ships to someone outside of CA or NV, the receiver would technically be responsible to pay a use tax.

Hypothetically of course, since he's obviously shipping Olive Oil, which is exempt from sales tax in most states.

Each state has its own sales and use tax statutes. What makes you think it's a use tax issue and not sales tax? I think CA charges sales tax whether or not the buyer lives in the state.
