Hi,

Please pardon me if this has been discussed here before, but I searched the forums and did not find any threads on this topic. I'm new to these forums.

We've created a service ZeeMaps that allows people to conveniently mark locations of interest to them on an interactive world map.

For example, yesterday I created a map of the latest WSJ recommendations for Pinot Grigio's. You can click on a marker on the map and it will bring up the details of the recommendation.

Such maps can be created by one person and group members can add or modify entries using a member password. Hence, they can be used by a group to make interactive maps.

I'd very much like to get the opinion of this group on the use of such mapping for wine origins. Since this is something we are actively working on, if you have suggestions for improvements, we'd love to hear them.

Are you aware that "Dow Jones Index" is a registered trademark and you are infringing?

Oops. No, I was not aware of it.

If the registered trademark is for 'Dow Jones Index' then maybe using 'The Dow Jones Pinot Grigio Index' is okay?

Alternatively, I can name the map 'Wall Street Journal's Pinot Grigio recommendations'?

No, you can't use any part of the trademark, especialy FAMOUS trademark in the name.

This is an invitation for troubles. I am not a lawyer, I don't play one on TV, and my suggestion is just a suggestion nobody should pay any attention to.

I just happened to see LOTS of good money wasted by folks whom famous trademark owners have decided to make a target.

"'Wall Street Journal's " is also a registered trademark and I don't see them been happy by dilution of it.

Agreed with Serge, best not invite a fight with the big boys. The money they'd use to fight something like this is petty cash to them, but the difference between life and death for you. So even if you're right you'll lose in the end.

Basically if you say that you got the information from WSJ there should be no problem, but if you imply that what you've done is sanctioned, approved and/or part of the WSJ you can get into big strife.

Listen I think what you've done is great and very useful, but just avoid copyright issues for your own peace of mind.

Thanks. I changed the name of the map to 'A demo based on WSJ information.' Should be okay?

Yes, that looks like a good effort.

Lou is doing a Google Earth map, which is a bit different than doing it collectively through a web site. As was pointed out in that discussion, it is difficult or impossible to make changes collectively to a Google Earth map, while ZeeMaps has a 'member' password that can be used to make changes by each member. A separate 'moderator' password allows for more priviliges.

WinRAR is a winzip type application, but better. Get it here:
